Should I get the contract reviewed before I sign?
Yes. Once contracts are exchanged you are bound by the terms, apart from your cooling-off rights. A review before you sign lets you understand special conditions, deadlines and risks while you can still negotiate or walk away.
How does the cooling-off period work in NSW?
For most residential purchases you have five business days after exchange to change your mind, ending at 5pm on the fifth business day. Off-the-plan contracts have 10 business days. If you withdraw during cooling-off you must pay the seller 0.25% of the purchase price. There is no cooling-off period if you buy at auction.
Can I waive the cooling-off period?
Yes. You can waive it by giving the seller a section 66W certificate, which your solicitor signs after explaining what you are giving up. Waiving is common in competitive markets, but it means you are bound as soon as contracts are exchanged. Get advice before you do it.
Do first home buyers pay stamp duty in NSW?
Under the First Home Buyers Assistance Scheme, eligible buyers pay no transfer duty on homes valued at $800,000 or less, and reduced duty on homes valued from $800,000 to $1 million. For vacant land, the full exemption applies up to $350,000, with reduced duty up to $450,000. You must be 18 or over, an Australian citizen or permanent resident, and live in the home for at least 12 months.
Can I get the First Home Owner Grant on an existing home?
No. The $10,000 First Home Owner (New Home) Grant only applies to new homes valued up to $600,000, or house-and-land packages up to $750,000. It is not available when you buy an existing home. You apply through your lender when arranging finance.
Can you handle my sale and purchase at the same time?
Yes. Kelly Batey acts on both transactions and lines up the settlement dates, so your sale and purchase settle in the right order. This is common for downsizers moving from the family home into something smaller.
